HHS Collects Over $783,000 In Stark Law Self Disclosures

The Department of Health and Human Services (HHS) announced it has collected $783,060 through settlement of Stark Law violations that were brought to light via self-disclosure.

The Medicare Self-Referral Disclosure Protocol (SRDP) is a system that allows those who believe they have violated the Stark Law to report the violation to HHS through its website.  In doing so, the Secretary of HHS has the authority to reduce the penalties levied against the violator.

According to the report, HHS has received 150 disclosures on its website since SRDP was enacted in September 2010.  CMS has resolved six of those disclosures for $783,060 and is waiting for additional information for 61 disclosures.  Fifty-one disclosures are under review, and the rest are longer in the SRDP or are being held “due to circumstances outside of CMS’s control.”
