Client Problem/Case Background
Our client was subject to suit after a sub-contractor performed non-union work on the client’s property and was reported to his union. This work was a violation of the sub-contractor’s union contract, and his pension was suspended as a result. He filed claims against our client and the union that included breach of contract, nuisance, negligence, and defamation.
DBL Resolution
After oral argument, DBL was successful in obtaining summary judgment on each of the sub-contractor’s claims in the Hamilton County Court of Common Pleas. The sub-contractor appealed to the First District Court of Appeals. DBL successfully briefed and argued the case to a panel of First District judges, and they affirmed the lower court’s decision in favor of the financial services firm. The sub-contractor appealed to the Ohio Supreme Court and asked for consideration of his case. The Court declined to hear the case after the firm was successful in demonstrating to that the sub-contractor’s claims had no merit.
Ultimately, the sub-contractor was angry about the loss of his pension and attempted to blame our client and the union via his lawsuit. DBL demonstrated to the state courts at each level that the sub-contractor’s claims were baseless. The firm successfully defended against the sub-contractor’s many claims and provided a favorable result to our client.
