David Kramer is one of DBL's top trial attorneys.  In a span of less than 90 days in late 2006, he won three defense jury verdicts in three different venues, culminating in victory in a five-week trial in which the plaintiff asked the jury for over $120 million in damages.  He also serves as the primary author of the sixth edition of Thomson/West's two-volume annotated treatise on the Kentucky Rules of Civil Procedure.  The treatise, which is updated annually, is widely regarded as the leading authority on the Kentucky civil rules. 

Dave's practice is concentrated in the areas of health law, civil litigation and appellate practice.  While his main practice area is medical malpractice defense, he advises the firm's health-care clients in a variety of areas, and has represented hospitals and physicians and acted as a hearing officer in medical staff corrective action proceedings. 

In the appellate field, he has briefed and argued cases in the Kentucky Court of Appeals, Kentucky Supreme Court, and the federal Sixth Circuit Court of Appeals.  Recent opinions from cases he has handled include:

  • Gilbert v. Com., Cabinet for Health & Family Services, 2008 WL 466081 (Ky. App. 2008) (not yet final).
  • Leonard v. St. Claire Medical Center, Inc., 2007 WL 625074 (Ky. App. 2007).
  • Physician Services, P.S.C., v. Birdwhistell, et al., 2007 WL 1558513 (U.S.D.C., E.D.Ky 2007).
  • Cavana v. Love, 2005 WL 1415361 (Ky. App. 2005).
  • Compton v. St. Elizabeth Medical Center, Inc., 2005 WL 327116 (Ky. App. 2005).
  • Straub v. Kilgore, 100 Fed.Appx. 379 (6th Cir. 2004).
  • Johnson v. St. Claire Medical Center, Inc., 2003 WL 22149386 (Ky. App. 2003).

In January 2008, he was elected to the Board of Governors of the Kentucky Bar Association.  The Board works with the Kentucky Supreme Court to oversee and regulate the practice of law in Kentucky.  In May 2008, he was appointed by Governor Steve Beshear to serve as a Special Justice of the Kentucky Supreme Court in the case of Cape Publications, Inc. d/b/a The Courier-Journal v. The University of Louisville Foundation, Inc.

Dave regularly lectures and publishes on topics related to health law and civil litigation.  He is also very active in public and community service.  He has served since January 2000 as a member of the Crestview Hills City Council, and from 1993 to 1998 he was a member of the Board of Directors of the Kentucky Lottery Corporation.  Among other community service activities, he is a past Chair of Covington Latin School Board of Education and a past Board Chair of the Mental Health Association of Northern Kentucky.  He resides in Crestview Hills with his wife and daughter.
